Many unpaid work situations are unlawful and are likely shams created by employers to avoid the obligation to pay. An example is where you're employed and then told you have to go through an unpaid training period. This is unlawful; even if you're training, you have the right to payment because you're going to work.
So, in order to calculate the amount of money a non-exempt employee should receive, an employer must determine the number of hours of work or "compensable time." Compensable time or working time is defined as any time the employer permits or allows an employee to perform the activity.
Many employers provide employees with a rest or lunch break, whether paid or unpaid. If you get meal or rest breaks, your employer doesn't have to pay you for that time unless: your state's law requires paid rest breaks (see "State Laws on Rest Breaks," below) you have to work through your break, or.
Disadvantages of salaried pay

If you are given a lunch break, it is not considered to be a part of your work time. This means that if you are given an hour lunch break and take it, it will not be included in your total hours worked for the week and will not have to be compensated.
You have a standard working week and a maximum limit of ordinary hours in a day. Anything over this limit has to be counted as overtime or TOIL. If you work for six hours you are entitled to two rest pauses, one in the first and one in the second half of the working day. Your boss should offer you your break.
Unlike a salary where you make the same amount regardless of how much time you work, hourly workers are paid for exactly the amount of time they spend working. A fixed hourly rate of pay means you have a set amount you're paid for each hour of work you perform.

The federal minimum for overtime for hourly employees is that the person ?must be paid one and a half times the regular hourly rate for work over 40 hours a week. So, an hourly employee working 45 hours a week for $10 an hour would be paid $10 for 40 hours and $15 an hour for the 5 hours of overtime.
If his regular hourly rate is $15, the double-time rate equals $30 per hour. Multiply the eligible hours by the double-time rate. If the employee works eight hours on a holiday, you have $30 times 8 , which equals $240. Multiply other hours worked by the regular rate.

Double-time pay is a pay rate that is twice the employee's normal rate of pay. Employees might be eligible for double-time pay when they work overtime hours, or holiday pay for employees working on federal holidays.
Once an eligible employee works 40 hours in a week, additional hours must be paid at a minimum overtime rate of time and a half, which is 1.5 times an employee's regular hourly wage. For example, if Jess is typically paid $15 per hour, that means she makes $22.50 per hour with time and a half ($15 × 1.5).
