House Bill 2588 introduced in 2018 states those who "fraudulently misrepresent" service animals can be fined $250. CALIFORNIA. Penal Code 365.7 introduced back in 1995. Those pretending to be an owner of a service dog is a criminal misdemeanor punishable by a fine of up to $1,000 and/or up to six months' imprisonment.
Generally, it will be easy to recognize a “real” service dog by their focused, disciplined, non-reactive behavior. Service dogs should not be easily distracted, dragging their handler against their will or leaving their handler to visit everyone they pass.
Staff may ask two questions: (1) is the dog a service animal required because of a disability, and (2) what work or task has the dog been trained to perform.
No Papers, No Problem
You can legally ask if the animal is a service dog animal required because of a disability. However, since certification isn't necessary for an animal to be a service animal, papers cannot be a condition for allowing the animal in.It's OK to pet a ESA; in fact, being petted is one of its primary jobs. It's always a good policy, however, to ask before attempting to pet any animal. Service dogs are allowed to go anywhere their handler goes, are not to be separated from its human and do not have to wear a vest.
A growing number of states have passed laws making it illegal to falsely claim that you are entitled to be accompanied by a service animal. In some states, it's illegal to falsely misrepresent that your pet or other animal is a service animal (by, for example, putting your dog in a “guide dog” or “service dog” vest).
To be eligible for a service dog, an individual must: Be at least 12 years of age unless service dog is needed for a child with autism. Have a diagnosed physical disability or anxiety disorder such as PTSD. Also check for debilitating chronic illness, or neurological disorder affecting at least one limb.
Service dogs are not pet dogs — they are trained to specific tasks for their handler, to mitigate their disability. All that is required of any restaurant is to ignore the dog and seat and serve the patron. Most service dogs have been taught to go under the table and lie down, and to stay out of the way."
A public accommodation or facility is not allowed to ask for documentation or proof that the animal has been certified, trained, or licensed as a service animal. Entities cannot require anything of people with service animals that they do not require of individuals in general, with or without pets.
You may be surprised to learn that according to the Americans with Disabilities Act Service Dogs are not required to wear a vest at all, in fact they are not required to have any identification at all.
Step #1 – Train your dog to provide a task as a service dog
In general, a Service Dog has to be well-trained. They need to follow basic obedience commands and perform their trained task for your disability. Basic obedience skills are the first step to training a Service Dog.Dogs are the most common type of service animal used, but the following animals are also permitted to be specially trained as a service animal:
- Miniature Horses.
- Ferrets.
- Capuchin Monkeys.
- Boa Constrictors.
- Parrots.
- Potbelly Pigs.
A service dog is specially trained to perform a function or job for an owner that has a physical, intellectual, or emotional disability. An emotional support animal serves as more of a companion for the owner.
A psychiatric service dog is a dog that helps someone with anxiety, depression, bipolar disorders, or other mental health conditions. All service dogs have completed specialized training and are legally recognized by the Americans with Disabilities Act (ADA).
You can't pet Service Dogs because it's distracting, and if a working dog is distracted because of something you do and their handler gets sick or injured, it's your fault.

Does the ADA require service animals to be professionally trained? A. No. People with disabilities have the right to train the dog themselves and are not required to use a professional service dog training program.
Under the ADA laws, the hotel cannot charge an extra fee for the service animal as they would another client with a pet. This also means you and your dog will be allowed in the public areas of the hotel, as well as having the right to a floor and room that are not normally designated for people traveling with pets.
Emotional support animals are not allowed in hotels unless it's a pet-friendly establishment. Nonetheless, there are laws that protect individuals with disabilities and their ESA. For one, you should not be denied housing rights just because you have a therapy dog.
Service animals must be under the control of their person AT ALL TIMES in order to be allowed to accompany their person into any establishment. This also means that service animals cannot be left alone in hotel rooms when their person leaves.
It does not matter if the dog was present to provide emotional comfort to its owner — if it bites another person, the owner is liable. However, if a dog or other support animal has not been properly trained and hurts another person, the owner of that animal should be held responsible.
A: The ADA requires that service animals be under the control of the handler at all times. In most instances, the handler will be the individual with a disability or a third party who accompanies the individual with a disability.
Allowing an employee to bring a dog to work can qualify as a reasonable accommodation, but only if the dog qualifies as a “service animal” under the ADA. However, a dog that has not been trained in any specific task and provides only emotional support or comfort does not qualify as a service animal.
California law allows persons with disabilities to bring service dogs and emotional support animals to work, with some limitations. This protection from disability discrimination requires employers to work with employees to accommodate their disabilities in reasonable ways.
If you have a service dog and need them to be on high alert, then having them live with another dog may create more complications than benefits. A service dog can be trained to perform their function despite the presence of another dog but this requires specialist training and some work to be done around the other pet.
According to the American Disabilities Act, or ADA for short, service animals must be trained to work or perform tasks for a disabled person to qualify as a service animal. These dogs have rights to all public access areas and are individually trained to work with people with PTSD.
The law also prevents additional pet fees for ESAs. Small ESAs can also travel with you on a plane free of charge. Unlike service dogs, ESAs aren't allowed into other public places that don't normally allow pets. In order to get the benefits of an ESA, you will need a “prescription” from a mental health professional.
Can a Business Stop You From Entering with Your Service Dog? In fact, they must allow an individual claiming their animal is a service dog to enter. Refusing service is a violation of the Americans with Disabilities Act, which can result in penalties, fines, and money damages.
Do I Qualify for an Emotional Support Dog Letter? If you have a mental disability – such as depression, anxiety, or other psychological disorder – you may qualify for an emotional support animal. It is well documented that support animals provide a therapeutic benefit to their owners through comfort and companionship.
First off you must be diagnosed by a mental health professional, therapist or a psychologist. These are the only people that can prescribe an ESA. He/she must be licensed in their field and be willing to write you a letter/document stating you need an ESA.
You can have more than one ESA. As long as the animal(s) does not violate any state or local laws and your therapist agrees your ESAs are there for your well-being, you can have more than one emotional support animal. The number of emotional support animals you have must also make sense.
