Holiday Overtime and State LawThese employees must receive overtime pay for time worked on Columbus Day or Veterans Day at one and one-half times their regular pay rate. The overtime must be voluntary and an employer may not fire or discipline an employee because she refused to work overtime on any of those days.
In New York, a private employer can require an employee to work holidays. A private employer does not have to pay an employee premium pay, such as 1½ times the regular rate, for working on holidays, unless such time worked qualifies the employee for overtime under standard overtime laws.
